1. Acceptance of Terms

By accessing and using MAPHYPEE AI ("Service", "Platform", "we", "us", "our"), operated by MAPHYPEE, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your access to and use of our AI-powered image and video generation services, including but not limited to text-to-image, image-to-image, image-to-video, and motion control features.

2. Description of Service

MAPHYPEE AI provides artificial intelligence-powered content generation services. Our platform allows users to:

• Generate images from text prompts using AI models
• Edit and transform existing images using AI technology
• Create videos from images using AI video generation
• Apply motion control to images and videos
• Access various AI tools through a unified interface

3. User Accounts and Registration

To access certain features of the Service, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and identification
• Accept all responsibility for activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Payment Terms

Our Service operates on a credit-based system. Credits can be purchased through our payment processor, Shopier. By making a purchase, you agree to:

• Pay all charges associated with your account at the prices in effect when such charges are incurred
• Provide current, complete, and accurate purchase and account information
• Promptly update your account and payment information, including email address and payment method
• All payments are processed securely through Shopier, and we do not store your full payment card details
• Credits are generally non-refundable. Exceptions are limited to system errors or rare cases reviewed via support
• Purchased credits do not expire; as long as your account remains in good standing, you can use them at any time until your balance reaches zero.

Payment Processing: Payment Processing: All payments are processed by Shopier. Your use of our payment provider is subject to its terms and privacy policy. By using our Service, you agree to the payment provider's terms.

5. Acceptable Use Policy

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Create content that infringes upon intellectual property rights, privacy rights, or other rights of any third party
• Generate content that promotes violence, hate speech, discrimination, or illegal activities
• Create deepfakes or misleading content intended to deceive or harm others
• Create adult content or sexual services content (including pornography)
• Use the Service to generate content for spam, phishing, or other fraudulent activities
• Create or falsify official documents such as IDs, passports, driver’s licenses, or financial documents
• Generate content intended to bypass KYC/AML, biometric verification, face recognition, age-gating, or similar security systems

6. User Responsibility for Generated Content

Our AI models generate content based on your inputs, but we do not guarantee the accuracy, completeness, or suitability of any generated content for your intended purpose. You acknowledge and agree that:

• AI-generated content may contain errors, inaccuracies, or unintended elements
• You must review all generated content before use, especially for commercial, legal, or sensitive applications
• You are solely responsible for verifying the accuracy and appropriateness of generated content for your specific use case
• You must ensure that any use of generated content complies with applicable laws, regulations, and third-party rights
• We are not liable for any consequences arising from your use of generated content without proper review
• For content involving human faces or representations, you must verify that it does not resemble or could be mistaken for a real individual without their consent

Human Review Requirement: Human Review Requirement: For any content intended for public distribution, commercial use, or legal purposes, we strongly recommend that you conduct thorough human review to ensure accuracy, appropriateness, and compliance with all applicable requirements.

7. Intellectual Property Rights

User-Generated Content: You retain ownership of content you create using our Service. However, by using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your content solely for the purpose of providing and improving the Service.

Service Content: All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, and software, are owned by MAPHYPEE or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

AI-Generated Content: Content generated by AI may be subject to copyright and other intellectual property laws. You are responsible for ensuring your use of AI-generated content complies with applicable laws and third-party rights.

8. Credits and Refunds

Credit System: Our Service uses a credit-based pricing model. Different operations consume different amounts of credits:

• Text-to-Image (Standard 1024×1024): 4 credits per image
• Text-to-Image (Pro, higher quality): 18 credits per image (1K/2K), 24 credits (4K)
• Image-to-Image (Normal / Restyle): 18 credits per image; 24 credits for 4K
• Avatar Pose / Reframe: 18 per image (4K: 24); Ideogram Reframe: 18 per image
• Image-to-Video (Kling 3.0): 5 s 200, 10 s 400 credits (per second × 40); Kling 2.6 Std: 5 s 110, 10 s 220 credits
• Grok Image-to-Video (720p, 6 s): 40 credits

Refunds: Refunds are generally not available. Exceptions are limited to system errors or rare cases reviewed via support.

• System errors that prevent service delivery
• Exceptional cases approved in writing by support

Refund decisions are at our sole discretion; approved refunds are processed through the original payment method.

9. Service Availability and Modifications

We strive to maintain high availability of our Service but do not guarantee uninterrupted access. We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time
• Update pricing and credit costs with 30 days' notice
• Perform maintenance that may temporarily interrupt service
• Limit access to certain features based on account type or usage

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAPHYPEE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any breach of these Terms. Upon termination:

• Your right to use the Service will immediately cease
• Any unused credits may be forfeited
• We may delete your account and associated data

You may terminate your account at any time by contacting us. Upon termination, you will lose access to all content and data associated with your account.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved by the courts of Turkey and in accordance with the Istanbul Arbitration Centre (ISTAC) rules, except where prohibited by law.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
